1. Acceptance of Terms

By accessing and using the OFA platform ("Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Platform.

OFA operates as a marketplace intermediary connecting verified creators (sellers) with registered buyers through auction-based sales of memorabilia and apparel.

2. Eligibility

• You must be at least 18 years of age to use this Platform
• You must provide accurate and complete registration information
• You must maintain the security of your account credentials

3. Platform Services

3.1 For Buyers

• A paid subscription is required to place bids:
  • Standard: $6.99 AUD/month - Full bidding access
  • Premium: $14.99 AUD/month - Early bidding access and exclusive auctions
• Premium subscribers receive early access (15 minutes) to all auctions
• Bids are binding commitments to purchase at the bid amount
• Winning bidders are obligated to complete payment
• All auction prices are displayed excluding GST; GST is added at checkout
• By registering, you agree to receive newsletters and special auction announcements

3.2 For Creators

• Creator accounts require identity verification (18+)
• Your first auction is commission-free to help you build confidence in the platform
• All listings must comply with our content guidelines
• Creators are responsible for accurate item descriptions
• Creators must ship items within 3 business days of sale
• Payouts are released 7 days after confirmed delivery
• Payments will only be released to valid bank accounts - no third party payments

4. Auction Rules

• Prime auctions run between 7:00pm-10:00pm AEST
• Auctions close at midnight AEST, depending on the number of items being auctioned
• Premium subscribers get early access bidding privileges
• Anti-sniping protection: Bids in the last 2 minutes extend the auction by 2 minutes
• Reserve prices may apply; items may not sell if reserve is not met
• All prices are in Australian Dollars (AUD) excluding GST
• GST (10%) is added to the final winning bid at checkout

5. Commission Structure

OFA charges the following commission rates per auction event:

• First auction: FREE (0% commission to build confidence)
• 1 item per auction: 20% platform commission
• 2-5 items per auction: 15% platform commission
• 6+ items per auction: 12% platform commission

GST applies to all commission charges in accordance with Australian tax law.

6. Prohibited Content

The following content is strictly prohibited on OFA:

• Explicit or adult content of any kind
• Items containing bodily fluids
• Sexual descriptions or erotic storytelling
• Custom wear commissions or special requests
• Counterfeit or non-authentic items
• Illegal items or substances

Violations may result in immediate account termination without refund.

7. Shipping & Delivery

• Creators ship directly to buyers with tracking
• Buyers are responsible for providing accurate shipping addresses
• OFA is not liable for lost or damaged items during shipping
• International shipping available to supported regions

8. Disputes & Refunds

• Disputes must be raised within 7 days of delivery
• OFA will mediate disputes between buyers and creators
• Refunds are subject to approval and handled on a case-by-case basis
• Subscription fees are non-refundable

9. Limitation of Liability

OFA acts as a marketplace intermediary and is not responsible for the quality, authenticity, or condition of items sold through the Platform. Our liability is limited to the fees paid to OFA for the relevant transaction.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia, Australia.
